Joe Moinian Slapped With Suit

Clever little diversion, Joe Moinian! The same day the real estate mogul's son and heir apparent was treated to a splashy story in the Observer, his real estate company was hit with a lawsuit over its latest development, 95 Wall Street. It seems the name that Moinian picked for the glitzy financial district building, Dwell95, isn't sitting well with the home design magazine that goes by the same name. Yesterday afternoon California-based Dwell filed suit against Moinian in US District Court, alleging that Moinian's development—which was designed by Philippe Starck and officially launched on Monday—violates a trademark held by the magazine since 1999. The mag argues that not only did Moinian rip off the name, his company also "depicted this trademark using a font and style that are nearly indistinguishable from the font and style used by Dwell." Today's suit wasn't a surprise for the Iranian-born tycoon. According to the legal papers, Dwell contacted Moinian to try and settle the matter back in March, and later engaged in "face-to-face" settlement talks with Moinian's company but never reached an agreement. And while the suit doesn't specify a dollar amount that Dwell is seeking, it's worth noting that they're asking for "three times Defendants' profits from its use of the Dwell trademark," which could add up in a hurry when you're marketing $2,700-a-month studios! The art world was all aflutter last night when its newest patron Dasha Zhukova, the comely and unloquacious consort of Russian billionaire Roman Abramovich, opened the Garage, her Moscow exhibition space in an 8,500-square-foot former bus shelter just outside the city center. Ever discreet, she wouldn't reveal how much it had cost to bring the gallery to life, although, reports Reuters: "When asked if he had sponsored Garage, Abramovich broadly smiled, smoothed out his blue suit, but did not answer." We're going to take that as a yes! Meanwhile, a Guardian journalist ever so tentatively says to Zhukova: "Could I be so bold, perhaps, as to ask if Mr. Abramovich was supportive of your idea?" To which her cool (but podcasted!) response is "I don't comment about Mr. Abramovich." Oh, Dasha, such gallant protectiveness only makes us more curious!

"In the midst of the storm, it's only natural to wonder where the future will lead," the spot stars off before adding that "no adversity lasts forever." So true, so true.

Detoxing (the respectable way to refer to starving yourself to drop as many pounds as possible in as short a time as possible) has been cleverly co-opted by makers of "cleanse" drinks, like Blueprint (Tatiana Boncompagni's favorite, just $75 for a day's worth of vegetable water!), which has replaced last year's cayenne pepper and maple syrup "master cleanse" as the fashionable way to get skinny while pretending you're relieving your organs of toxins. The new issue of Allure dedicates an entire feature to "detox diets," with quotes from the pushers of drinks like Blueprint and their devotees. Sorry Allure, simply replacing solid food with liquid is passé—anyone who's anyone is removing the digestive system from the equation entirely and hooking themselves up to an IV.

Since Lehman Brothers filed for bankruptcy on Monday, lots of people have wanted to talk to Richard Fuld (in a dark alley, preferably). But the Lehman CEO hasn't been seen in days. Now Rep. Henry Waxman has requested Fuld show his face before Congress next week to address "regulatory mistakes and financial excesses" that led to the firm's bankruptcy.
