Texas Man Convicted of Murder for Second Time in Retrial of Stand Your Ground Case

A Texas man, Raul Rodriguez, received a life sentence on Tuesday, after being convicted of murder on Friday, for the second time, ABC 13 reports. Rodriguez was first convicted in the shooting death of elementary school teacher Kelly Danaher in 2012, but an appeals court ordered a retrial.
On the night of May 2, 2010, investigators said, Rodriguez, carrying a gun, a flashlight, and a video camera, went to Danaher’s home to confront him about loud music coming from his house.
The whole confrontation was filmed. Rodriguez narrates:
Danaher was killed, and two others were injured.
Rodriguez’s wife Donna Malone defended him during his first trial, ABC 13 reports. They’ve since divorced, and Malone took the stand against her ex-husband, testifying that the night of the shooting he paced around their home for hours before going outside.
“Every time he’d go out and look for the loud music, I thought he shouldn’t leave the house cause you get that feeling something’s gonna happen, and it did,” Malone said.
The sentence in his first conviction was 40 years, of which he served two before being released from prison on appeal. The sentence in the new conviction is for life.
