According to the L.A. Times, prosecutors in Los Angeles County have officially charged Robert Durst with the 2000 murder of long-time friend Susan Berman.

The filing charges Durst of one count of murder in the first degree with special circumstances—murder of a witness, lying in wait, and using a gun.

Those special circumstances make Durst eligible for the death penalty under California law. Buzzfeed reports that prosecutors have not yet decided whether they will pursue that option.
