Kim Davis, the Kentucky county clerk and Christian conservative hero who went to jail last week for refusing to issue marriage licenses to same-sex couples, was ordered released by a federal judge today.

U.S. District Judge David Bunning—who ordered Davis jailed in contempt of court Thursday—ruled today that she should be freed, citing the fact that five of Davis’ six deputies have issued marriage licenses while she has been incarcerated. “On September 8, 2015, Plaintiffs filed a Status Report at the Court’s behest. According to the Report, Plaintiffs have obtained marriage licenses from the Rowan County Clerk’s Office,” Bunning said in an order. “The Court is therefore satisfied that the clerk’s office is fulfilling its obligation to issue marriage licenses to all legally eligible couples.”

Davis found infamy for refusing to issue any marriage licenses, including licenses to same-sex couples, in defiance the U.S. Supreme Court’s June ruling that legalized gay marriage nationwide. According to a statement issued by her Attorney on Friday, Davis will not resign over the controversy.
